Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Still Us ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms form a binding agreement between you and Still Us.

2. Eligibility

You must be at least 13 years of age to use Still Us. By using the App, you represent and warrant that you meet this requirement. If you are between 13 and 18 years of age, you represent that your parent or guardian has reviewed and agrees to these Terms.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorised use of your account. We are not liable for any loss resulting from someone else using your account with or without your knowledge.

You may not create accounts for others without permission, or use the App to impersonate another person.

4. Partner Linking

Still Us is designed for use by two people in a relationship ("partners"). By linking with a partner using an invite code, you consent to sharing certain data with that person as described in our Privacy Policy.

You are responsible for ensuring you only share your invite code with someone you trust and intend to connect with. We are not responsible for any consequences arising from sharing your invite code with the wrong person.

5. Acceptable Use

You agree not to use the App to:

  • Harass, threaten, or harm another person
  • Share illegal, abusive, or otherwise harmful content
  • Attempt to gain unauthorised access to any part of the App or its infrastructure
  • Reverse engineer, decompile, or disassemble the App
  • Use the App for any commercial purpose without our express written consent
  • Violate any applicable law or regulation

We reserve the right to terminate your account and access to the App immediately if we determine, in our sole discretion, that you have violated these terms.

6. Content You Create

You retain ownership of the content you create in Still Us (messages, tasks, events, etc.). By creating content, you grant Still Us a limited, non-exclusive licence to store and process that content solely for the purpose of providing the service to you and your linked partner.

You are solely responsible for the content you create. We do not review user content and are not liable for any content you or your partner create.

7. Special Messages

Still Us provides special message types including time-delayed, time-locked, and password-locked messages. These features are provided as-is. While we make reasonable efforts to deliver time-delayed messages at the specified time, delivery may be affected by device settings, push notification permissions, or infrastructure issues. We are not liable for late or undelivered messages.

Password-locked messages are verified server-side. You are responsible for communicating the password to your partner through a separate channel.

8. Intellectual Property

The Still Us App, including its design, code, graphics, and branding, is owned by Still Us and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

9. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STILL US SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR DAMAGE TO RELATIONSHIPS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

11. Termination

You may stop using Still Us at any time by deleting the App from your device. You may request deletion of your account and data by contacting us at support@stillus.app.

We reserve the right to suspend or terminate your access to the App at any time, for any reason, including violation of these Terms.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notification. Your continued use of the App following notification of changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which Still Us operates, without regard to conflict of law principles.
